Based on the same facts as in Question 9.17 above, would Z Bhd be required to make an immediate announcement pursuant to Rule 9.19(33) of the ACE LR notwithstanding that Z Bhd has yet to proceed with the purchase of the additional equipment?
Yes, Z Bhd would be required to make the immediate announcement pursuant to Rule 9.19(33) of the ACE LR notwithstanding that Z Bhd has yet to proceed with the purchase. For purposes of Rule 9.19(33) of the ACE LR, listed corporations would inherently be required to make the announcement once a decision has been made to change the proposed utilization of proceeds and not until actual implementation of the change.
